General Terms and Conditions (AGB)

1. Geltungsbereich

1.1. The business relationship between Ashraf Mohamed, Ernestgrün 28, 95698 Bad Neualbenreuth, Deutschland (hereinafter referred to as the “vendor”) and the customer (hereinafter referred to as the “customer”) is exclusively governed by the following General Terms and Conditions in the version valid at the time of order placement.

1.2. A consumer is any natural person who enters into a legal transaction for a purpose that is neither commercial nor self-employed. An entrepreneur is a person or partnership acting in their commercial or independent professional capacity when concluding a transaction.

1.3. Deviating terms and conditions of the customer shall not be recognized unless the vendor expressly agrees to them in writing.

2. Offers and Service Descriptions

2.1. The display of products in the online shop is an invitation to place an order and not a legally binding offer. Service descriptions in catalogues or on the website are not guarantees or promises.

2.2. All offers are valid “as long as stocks last” unless otherwise stated. Errors are excepted.

3. Order Process and Conclusion of Contract

3.1. The customer selects products and gathers them in a “cart” using the [Add to cart] button. The customer can proceed to the final step using the [Proceed to checkout] button.

3.2. By clicking the [Place order] button, the customer makes a binding request to buy the goods in the cart. Data can be amended at any time before placement.

3.3. The vendor sends an automatic confirmation of receipt via email. A binding purchase contract is only concluded if the vendor dispatches the product or confirms dispatch/sends an invoice within 2 days (7 days for companies).

3.4. For advance payment, the contract is concluded when the customer fulfills the payment request. If payment is not received within 10 days of the order confirmation, the vendor may withdraw from the contract.

4. Prices and Delivery Costs

4.1. All prices include statutory value-added tax (VAT) at the valid rate.

4.2. Delivery costs are charged in addition to the product prices and are clearly explained during the order process.

5. Delivery and Availability

5.1. Delivery occurs after receipt of the invoice amount for advance payments.

5.2. If delivery fails three times due to the customer’s fault, the vendor may withdraw from the contract; payments already made will be refunded.

5.3. If a product is unavailable through no fault of the vendor (e.g., supplier failure), the vendor will inform the customer immediately and refund any payments.

5.4. For entrepreneurs, the risk of loss passes to the buyer as soon as the item is delivered to the carrier.

6. Terms of Payment

6.1. The customer selects an available payment type before completing the order.

6.2. If third-party providers are used (e.g., PayPal), their specific terms and conditions apply.

6.3. The customer is in arrears if they fail to comply with a defined due date and is liable for statutory interest on arrears.

7. Retention of Title

The vendor retains the title of the goods supplied until full payment has been made. For entrepreneurs, title is retained until all claims from an ongoing business relationship are settled.

8. Customer Account

8.1. Customers can place an order as a guest or create a customer account.

8.2. Customers must provide truthful information and are responsible for keeping their data (e.g., email or address) up to date.

8.3. The customer account may be terminated by the customer at any time.

9. Product Warranty and Guarantee

9.1. Statutory warranty provisions apply.

9.2. For entrepreneurs, visible defects must be reported in writing within two weeks of delivery. Warranty for entrepreneurs is limited to one year after the transfer of risk.

10. Haftung

10.1. The vendor is liable without restriction for damage caused by willful intent or gross negligence.

10.2. For minor negligence, the vendor is only liable for the violation of fundamental contractual obligations, restricted to foreseeable typical damage.

10.3. Liability for damage to life, limb, or health remains unaffected.

11. Storage of Contract

11.1. The customer can print the contract during the order process.

11.2. The vendor sends an order confirmation containing all order data and a copy of the GTC via email.

12. Closing Remarks

12.1. The place of jurisdiction is the seller’s seat (Bad Neualbenreuth) if the customer is a merchant or legal entity under public law.

12.2. The law of the Bundesrepublik Deutschland applies, excluding UN sales law.

12.3. The language of the contract is German.

12.4. We are neither willing nor obliged to participate in dispute resolution proceedings in front of a consumer arbitration board.
